Great job on this. I enjoyed hearing all your different comments and views on this hot topic. I tihnk Sony is doing everything they can and I don’t expect to get any compensation for the PSN being down.

Sec 15 of the the SCEA TOS (WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY):
No warranty is given about the quality, functionality, availability or performance of Sony Online Services, or any content or service offered on or through Sony Online Services. All services and content are provided “AS IS” and “AS AVAILABLE” with all faults. SCEA does not warrant that the service and content will be uninterrupted, error-free or without delays. In addition to the limitations of liability in Sections 1, 2, 11 and 13 of this Agreement, SCEA expressly disclaims any implied warranty of merchantability, warranty of fitness for a particular purpose and warranty of non-infringement. SCEA assumes no liability for any inability to purchase, access, download or use any content, data or service.

Unfortunatley, we all had to agree to the TOS to use the PSN and as it says above that Sony never guaranteed that online services will be uninterrupeted or without delays and they are not liable for them being unavailable.

However, I do agree that they might have been able to communicate that there was a problem that they were investigating before they confirmed anything, but as someone said in this broadcast that has downsides too, i.e. causing panic, a slew of questions, etc.

All in all, I too just want to play online and use ps home like many others but at least we can still play locally and of course I’m sure many of us have plenty else in our lives to keep us busy. I myself got plenty else on my plate like school, work, and raising my daughter and taking care of my family.

Life isn’t waiting for the storm to pass, it’s about learning to dance in the rain!!!! Remain positive yall!!!

    Thanks Tbaby,

I agree with you that Sony doesn’t have to compensate. However, the language, you posted there is something all major corporations tack on to their services to protect themselves legally, but it would be and act of courtesy if they did so, plus it would keep a lot of their current subscribers loyal to the Sony brand.

I think the way that Sony handles this going forward will be telling of the type of company they are.

  3. Great discussion, a lot of valid points were made. Sony may have bit the big 1 by withholding info in regards to the compromise with our personal information, but they certainly have the balls to step up and take action against the parties involved with these attacks that most corporations won’t dare to take. Let’s hope the damage to the consumers doesn’t get any worse than it already is. Be cautious..info is floating about out there…

Meesh I need to borrow a sock, and tell Hippe and Narde not to quit their day jobs!

TBH, I will always appreciate what Sony did in having the nuts to put the smack down on these hacks. That being said I would like to know ASAP when my info gets ripped off! To hell with 3rd party security firms and confirmations. If these guys are smart enough to crack Sony’s security, best believe they can be at my front door saying they need to check my gas meter.

awesome show guys, keep it up!

  5. I agree with you Bernard. That language is just to protect Sony from a liability perspective. It will definitely be a gesture of good faith for Sony to provide us any kind of compensation and might please many of their consumers. But whatever they do, like one of yall said last nite. It is hard to please everyone. There is a broad spectrum of opinion of the PS3 PSN user base on this matter. It truly is “management 101″. There was a big problem and now a big part of it is damage control. I don’t envy Sony’s position as it certainly is a challenging one and a double-edged sword in many facets of it.

  6. ParameterX, I too appreciate Sony goin after those responsible for the security breach. I trust that they will be reprimanded appropriately to the fullest extent of the law and I wouldnt mind beating em down a little myself LOL.

But, I do see the other side of it. I think it was hippie that came on at the end of the broadcast and was talkin about the good motives that the hackers might have had in trying to point out weaknesses in the security Sony’s infrastructure. This has happened so many times in history with so many corporations. That story about IBM was mentioned last night. This has happened to Microsoft too. Improvements in security are the positive and the negative are the impact on the end users, us. I dont think that Sony should necessarily offer these guys a job like that situation with IBM but I’m just saying there could be some good that they see from what these hackers did. I don’t know the real motivations behind why these hackers did what they did so it is all speculation, but I doubt they really cared about our personal information and want to commit identity theft with our info. With their hacking abilities, Im sure they can hack into some bank and get all kinds of money, if that is what they cared about. Like someone said last night, I think this was about showing Sony that they could do what they did.

But again, no matter what the reason for the hackers actions, we the users do pay a price with loss of services and some even paid for like PS Plus, etc.

  7. I would definitely take the same precautions for monitoring credit as if PSN purchases were like any other kind of online transactions. I use freecreditreport.com myself to monitor my credit and I use a separate checking account for online shopping, separate from my main checking account. That was the advice I had gotten from my bank when my debit card # somehow got stolen last fall. I hear others talking about using PSN cards for PSN purchases from now on. That sounds good too, but what I am doing works for all online shopping, regardless of the merchant/vendor.

  8. I always enjoy a great conversation with my friends. Great Idea to do this Narde. with the comments above and the audio we all know how to protect ourselves to minimize damage. I hope Sony does holds those people accountable. I will still be a loyal Sony supporter because of their content and products I have come to enjoy and trust. I hope they build a better, stronger system in the future. it’s a set back for the avid PS Home users and rabid multiplayer gamers but this just gives us more time to perfect our single player skills, lol. those that are still around when the system comes online will be the elite PS fans and dedicated gamers. I look forward to seeing what they come up with and possibly how they plan to reward the believers that are still standing.

Great discussion about the latest in PSN News. But I think that HIPPE is not completely upto speed on the Apple GeoHotz jailbreak. Apple tried to use the DMCA to keep third party Apps from the iPhone/iPod without Apples approval or paying a “Royalty” to Apple. When Apple lost that lawsuit they just keep updating IOS to fight the Jailbreak, kinda like Sony fighting Homebrew on the PSP. Makes you wonder why Sony is using Android for the NGP since Android is so easily hacked for apps and games… But Sony going after GeoHotz is more about Securtiy since they stole Sony SDK software to create their Homebrew and that is what Sony could have been going after with the suit. Because the only way that they could get into the PSN was to create a “DEBUG” console to give it privileges that only a Game Developer could have on the PSN. In my opinion the PS3 is still safe and PSN is still secure.

I think SONY should place the hackers’s info on the blog the radio the 12 o’clock news. Then they probaly go jail peacefully to avoid the angry mobs at their doorsteps.
